IMPORTANT
✦ Commissions will take 2-5 weeks to complete after payment is received. Any hard deadline must be specified by the client before work begins.
✦ Rush orders (< 2 weeks) are subject to an additional fee of up to 50%.
✦ I, the artist, reserve the right to decline any commission inquiries.
✦ All communication will be done through VGEN or email ([email protected]).
✦ By commissioning me, you have read and accepted my T.O.S.
PAYMENT, REFUND POLICY, FEES
✦ A 50% deposit is paid upfront, and the remaining 50% payment fee is due after the art is finished. Payments will be made through VGEN.
✦ Commissioned pieces will not be delivered until payment has been received.
✦ If the client wishes to cancel the commission after paying the deposit, a refund will not be issued. Completed commissions are not eligible for refunds. Administrative fees are excluded from all refunds.
✦The client will be fully refunded if:
[The artist has not completed the commission within 2 weeks past the initial guaranteed delivery date.] OR [The artist cannot complete the commission.]
COPYRIGHT & USAGE POLICY
✦ I, the artist, retain full and exclusive rights to the original artwork. Therefore, I reserve full rights to:
• Post or display it online (website, social media, etc.)
• Promote myself with it (portfolio, commission sample, etc.)
✦ The artist reserves the right to share the commission process online. Prior notice is required to keep commissions private. NDAs are available for purchase.
✦ All commissions are by default for personal (non-commercial) use. For personal use commissions, the client is allowed to:
• Post the commissioned artwork on social media (e.g., Twitter) with credit given to the artist (@creampuffbuni).
• Use the commissioned artwork on public and non-exclusive streaming and video platforms without a paywall.
• Print the commissioned artwork for individual personal use, not to be distributed.
✦ The client is not permitted to use any part of the commissioned artwork in any AI- or blockchain-related technology, including, but not limited to, training AI, NFTs, and cryptocurrency.
COMMISSION PROCESS & DELIVERY
✦ Project Discussion & Invoice:
After reviewing your commission request, I will send a project contract and price for approval. I may request additional information about the project via VGen DMs.
✦ Upon mutual agreement, I will reach out to request necessary materials needed prior to sketch drafting (references, notes, etc.).
✦ References:
The client is expected to provide all necessary references to complete the commission.
• This includes both images (reference sheet, pinterest board, sketches, etc.) and text descriptions (character, props, etc.).
• Only completed character designs will be accepted as reference.
• The client is expected to provide details about what the commissioned artwork will be used for.
✦ After the sketch for the commissioned artwork is presented, you can request up to 2 changes. I will send the sketch for approval via VGen DMs. After the sketch is approved, only minor color changes are allowed. Please make sure you are happy with the sketch before approving it.
• Any request for a change beyond the permitted two will incur a 10% fee.
✦ Deliverables:
Upon completion, the commissioned artwork will be uploaded to Google Drive (as PNG), and a link will be shared with the client. Please download and save your commission on your device within 2 weeks of receiving the final commission files.
• Files are not kept permanently. Older works may be deleted to make space for newer works to be uploaded, as space is limited. Any files not saved within 2 weeks won’t be refunded if lost.
COMMERCIAL FEE
✦ All commissions are by default for personal (non-commercial) use.
Without commercial rights, the client is not allowed to:
• Use any commissioned works to produce physical merchandise for profit, including, but not limited to: prints, keychains, stickers, and wearables.
• Use any commissioned works for paid exclusive content (e.g., Patreon, Fansly, etc.)
• Reselling or redistributing any commissioned works.
✦ Commercial rights may be purchased as an upfront advance (300% of the final price)
✦ Merchandising will be subject to royalties (negotiated on a case-by-case basis).
✦ For commercial use, the client must credit Creampuff by screen name (@creampuffbuni) on any platform where the commissioned work is publicly displayed.
CONFIDENTIALITY
✦ Neither Party (Creampuff and the client) shall use, disclose, or make available the other Party’s Confidential Information to any third party, unless such use or disclosure is done in accordance with Creampuff’s Terms of Service.
✦ Each Party must hold the other Party’s Confidential Information secure and in confidence, except to the extent that such Confidential Information:
• is required to be disclosed according to the requirements of any law, judicial or legislative body, or government agency; OR
• was approved for release in writing by the other Party, but only to the extent of and subject to such conditions as may be imposed in such written authorization.
✦ This Confidentiality clause will survive cancellation of the commission and any other agreement and license.
✦ Failure to abide by the TOS may result in blacklisting from future commissions.
